Courts of Protection
If someone loses the ability to deal with his or her financial affairs before they have been able to sign a Lasting Power of Attorney, we can:
- advise on the merits of an appointment order from the Court of Protection, the specialist court dealing with issues relating to people who lack the mental capacity to make specific decisions
- make an application to the Court of Protection for an order to appoint a deputy to make decisions on their behalf, as set out by the court. Where required, we can act as a deputy, a position known as a receiver under the old system of Enduring Powers of Attorney
- assist with the management of the incapacitated person’s affairs.
