Issuing statutory demands

A statutory demand is another option to help you recover money you are owed by a debtor, particularly where you believe that they may deliberately withholding money rather than having difficulty paying.

We can advise and assist you in issuing a statutory demand against a company or an individual. The demand can be served as soon as the debt is due and without a court judgment having been made.

If they fail to respond within 21 days, you are then entitled to issue a winding up petition against a company or a bankruptcy petition against an individual.

The statutory demand can be a useful tool to encourage the debtor to pay promptly, although the debtor can apply for the statutory demand to be set aside.
