If you are not the natural parent of a child but you have put yourself forward as a carer for that child within care proceedings or you consider that you are better able to parent the child than his or her natural parents then you may wish to secure a Special Guardianship Order.

BTMK Family are able to fully advise on the effects of such an order and will be able to advise on the difference between a Residence Order and a Special Guardianship Order.

Such an Order can only be made by the court and 3 months’ notification of an intention to apply for such an order must be given to the Local Authority who has care of the child or in whose jurisdiction the child resides.
