Where families are unable to agree who should be the main carer for a child it is possible to ask the court to decide this delicate issue. We would recommend that you seek advice from BTMK Family preferably before separating from a partner if you wish to be considered as the primary carer for your child.

In some instances other family members may consider it appropriate to seek to care for a child, for instance a grandparent. BTMK Family are regularly asked to advise and assist in the preparation of such cases.

Given the importance of children and issues surrounding their upbringing we would strongly suggest that you seek advice from BTMK Family before making any decisions concerning a child’s future.

In all cases concerning children it is appropriate to try and negotiate an agreement between the parties involved. The adults have then taken decisions for the benefit of the child rather than having an order imposed on them by a court. BTMK Family are experienced in trying to negotiate on your behalf an appropriate outcome.

We will always consider with you whether it is appropriate for us to refer you to an outside agency to act as mediators in an attempt at settlement.

Where it is necessary to issue court proceedings concerning a child we confirm that our offices in Southend and Chelmsford are located sufficiently close to the Family Proceedings Court and the County Court in each town to make representation of you on an emergency basis extremely efficient.
