Redundancy

When declaring job losses, you must meet several obligations. These include demonstrating that there is a genuine need for redundancies due to a business or workplace closing or a reduced need for employees to do the available work.

You must also make a fair and objective choice of employees for redundancy and consider alternatives to redundancy such as redeployment. You must also consult with the affected employees or their workplace representatives, depending on the number of redundancies involved.

If you fail to follow fair procedures, this could result in redundant employees claiming that their dismissal was unfair.

When you are considering making staff redundant, the first stage in the process should be to seek expert legal advice, to ensure that you fully understand exactly what is involved and what steps you must take for legal compliance.

We can assist you with all aspects of the redundancy process, including written notice of redundancy, meetings with affected staff, appeal meetings, periods of notice, redundancy payments and paid time off for affected employees to look for a new job.
