In principle, redundancy situations occur in three defined circumstances: where a business closes; where a workplace closes; or where there is a diminishing need for employees to do the available work.
To ensure that any dismissal is deemed fair, employers should normally ensure that they consider an appropriate “pool for selection”, that they apply an objective selection criteria and that they consider alternatives to redundancy such as redeployment of the employee.
If employers fail to follow a fair procedure this could result in the redundant employee claiming that their dismissal was unfair. Employers should therefore seek advice well in advance of advising any employees that they are redundant. We can assist employers through all stages of the redundancy process.
