A number of the equal opportunities regimes recognise harassment as a free-standing form of discrimination.
Harassment is commonly defined as unwanted conduct that has the effect of either violating the employee’s dignity, or creating an intimidating, hostile, degrading, humiliating or offensive environment for the employee.
When deciding if the harassment has had the effect described above, a Employment Tribunal will consider all of the circumstances including the perception of the complainant.
