The statutory dispute resolution procedures introduced a three stage minimum procedure that must be adhered to when an employer is considering dismissing an employee or taking certain action short of dismissal.
It is therefore vital that employers have in place a written disciplinary procedure which complies with the statutory minimum requirements. In the event that an employer dismisses an employee without following the three step procedure and Employment Tribunal proceedings follow, the dismissal will be deemed automatically unfair and the compensation awarded to the employee could be increased by between 10% and 50%.
