Discrimination

Developments in equal opportunities legislation means that it is illegal for employers to make employment-related decisions or treat employees or prospective employees less favourably on the grounds of:

  • age
  • disability
  • gender reassignment
  • marital or civil partnership status
  • maternity or pregnancy
  • race
  • religion or belief
  • sex.

To avoid claims of discrimination, you must be aware of issues including the questions you are allowed to ask on an application form or at an interview or how to establish whether workers are legally entitled to work in the UK in a legally compliant way. You also need to be aware of the potential for discrimination in workplace arrangements, such as inflexible shift arrangements that might adversely affect single parents with young children.

We can advise you on ensuring that your recruitment practices and adverts are not discriminatory and that your record keeping will demonstrate that the steps you take when selecting a new employee are fair and non-discriminatory. We can also advise on any issues arising within the workplace involving allegations of discrimination.
