Victimisation

Victimisation is a form of discrimination that occurs when you are treated less favourably because:

  • you  have made, or intend to make, a complaint about discrimination or harassment
  • you have acted, or intend to act, as a witness or to give evidence in support of someone else relating to a complaint about discrimination or harassment.

Victimisation could include you having requests for time off refused, not being considered for training or promotion, being ignored by your manager or colleagues, criticised continually for your work or having your shift arrangements or work allocation changed frequently or at short notice.

Discrimination or victimisation carried out by a co-worker or in the course of their employment is treated as also being carried out by your employer, unless your employer can show they took all reasonably practicable steps to prevent this happening.

We can advise you on appropriate action and options for dealing with victimisation and on employment tribunal claims under anti-discrimination and harassment legislation or for constructive dismissal, where the employment relationship has broken down and you feel you have no option but to resign.
