Restrictive covenants

Employers are increasingly seeking to protect themselves against the activities of ex-employees that they believe could be potentially damaging to their own business.

Restrictions on the activities of ex-employees may be implemented through restrictive covenants in employment contracts, which are intended to take effect once employment has ended.

These are generally considered anti-competitive and in restraint of trade and are normally only enforceable provided they are only as wide as necessary to protect the employer’s legitimate business interests.

However, an employer may be able to seek an injunction or damages if an employee breaches a restrictive covenant and we can provide you with expert advice on the enforceability of such covenants.
