Redundancy

Your employer must meet several obligations when declaring job losses, which include demonstrating that there is a genuine need for redundancies due to a business or workplace closing or a reduced need for employees to do the available work.

They must also make a fair and objective choice of employees for redundancy and consider alternatives to redundancy such as redeployment of employees affected. Consultation must also take place with the affected employees or their workplace representatives, depending on the number of redundancies involved.
If employers fail to follow fair procedures, you could pursue a claim for unfair dismissal.

If your employer has told you that you may be made redundant, it is often useful to take independent legal advice from the outset. We can advise you on the fairness of the selection process and on any aspect of the redundancy procedure generally.
