Harassment

Harassment is commonly defined as “unwanted conduct that has the purpose or effect of violating people’s dignity, or creating an intimidating, hostile, degrading, humiliating or offensive environment.”

Your employer is responsible for preventing harassing behaviour. If discrimination or harassment is carried out by a co-worker or workers in the course of their employment, this is treated as also being carried out by your employer, unless they can show they took reasonable steps to prevent this. Your employer also has a duty of care and health and safety responsibilities towards you.

If you consider you are being mistreated and decide you wish to pursue the case to an employment tribunal, you will be expected to have explored all the available options to resolve the situation.

We can advise you on appropriate action and options for dealing with harassment and on employment tribunal claims under anti-discrimination and harassment legislation – in situations where you may still be working for your employer – or for constructive dismissal, where the employment relationship has broken down and you feel you have no option but to resign.
