disciplinary and dismissal

Dismissal can be both emotionally and financially devastating. It can adversely affect an individual’s confidence and their ability to obtain alternative work.

Since the introduction of the Statutory Dispute Resolution Procedures in 2004, employers are now required to follow a three stage minimum procedure when they are considering dismissing an employee or taking certain action short of dismissal.

If an employer dismisses without following the three step procedure, the dismissal may be deemed automatically unfair. If the employee pursues a claim in the Employment Tribunal the compensation awarded could be increased by between 10% and 50%.

If you have received notification of a disciplinary hearing or you feel you have been unfairly dismissed please contact our team for further advice.
