Compromise or severance agreements are legally binding documents which are normally used by employers to terminate an employment relationship.
Not all work place disputes have to end in either Court or Tribunal proceedings and compromise agreements are now frequently used to negotiate terms for an agreed departure. Normally compromise agreements offer the employee a sum of money in return for the employees’ agreement not to pursue certain legal claims against the employer.
Before a compromise agreement can be legally binding the employee must receive independent legal advice. It is normal for the employer to make a contribution towards those legal fees.
