
Breach of contract
An employer can breach your contract of employment in a number of ways. For example, they may fail to give you appropriate notice when terminating your contract or they may try seek impose changes in terms and conditions of employment without consultation.
If the breach is considered irreparable, you will be entitled to treat the contract as discharged, which means it is legally invalid.
We can advise you on whether your employer’s behaviour represents a breach of contract. If this is the case, we can assist you in pursuing action that may include suing your employer for damages for the breach.
If the breach is so serious that you feel you have to resign, we can also work with you in launching a claim for constructive dismissal, provided you have at least 12 months’ continuous service.
