Restraint, confiscation and cash seizure

The Proceeds of Crime Act 2002 is designed to ensure that criminal assets are immediately frozen or restrained and then confiscated at the conclusion of any case.

Financial orders are now becoming increasingly common, alongside criminal sanctions. In anticipation of confiscation, prosecuting authorities are regularly exercising their increased powers to restrain and freeze defendants’ assets before conviction or plea. Even if no criminal charges are brought, cash may be seized.

In this specialist field, we have experience in defending:

  • multi-million pound confiscation proceedings
  • the release of monies from restrained funds
  • variation of freezing orders.
