Freezing Orders can occur at any time of the year!
The Proceeds of Crime Act 2002 marked the latest efforts by the Government to ensure criminal assets are immediately frozen or restrained and then confiscated at the conclusion of any case. Financial orders in addition to criminal sanctions are now commonplace and, even when no criminal charges are brought, cash may be seized.
In anticipation of confiscation, prosecuting authorities are regularly exercising their increased powers to restrain and freeze defendants’ assets before conviction or plea.
