R v M

In this case W was alleged to have assaulted a pregnant woman and then attacked a number of her friends. W had a poor recollection of events due to the consumption of alcohol but was adamant he had not behaved unlawfully. During the incident W had sustained multiple injuries which did not appear consistent with the prosecution evidence. We adopted a pro-active approach to case preparation. We obtained CCTV footage which had been disregarded by the Crown as having no evidential value. The footage was submitted to forensic experts who enhanced images which showed W being attacked by men armed with pool cues. We then obtained expert medical evidence establishing the likely cause of the W injuries. We presented our evidence to the Crown who offered no evidence before the trial commenced.
