R v C

The defendant was alleged to have provided assistance to his brother who was accused of having murdered his girlfriend whilst trying to flee from a customs investigation in London.

The brother and the female had travelled to Suffolk and were planning to hire a boat and leave for the continent. The couple became involved in a heated argument and it was said that the female was viciously assaulted then thrown from a moving vehicle before the brother reversed over her.

The defendant was then telephoned and asked to meet his brother in London in the early hours of the morning. Following the meeting the two separate vehicles travelled to a fishing lake near Chelmsford where the deceased female was left. The two men returned to the London area and subsequently the brother was assisted by others and driven to Portsmouth where he caught a ferry to France and then flew on to Thailand.

Proceedings initially commenced against the defendant and two other individuals in 2005 in the absence of the alleged murderer. The police finally located the brother and he was extradited back to the UK.

A first trial was concluded with the Jury failing to reach a verdict. The defendant was convicted following the second trial and received a three year sentence of imprisonment which is currently the subject of appeal. The brother was similarly convicted of the murder charge.
