R v B

The defendant had been charged with two offences of being in possession of a firearm with intent to cause fear of violence and affray. The prosecution alleged that the defendant, together with a group of males, attended the aggrieved party’s address, that he brandished a firearm and threatened to use it.

The prosecution alleged that the defendant was the only person within the group to have not worn a balaclava and that he was previously known to the aggrieved. The defendant denied presence at the scene or being in possession of a firearm.

The case proceeded to trial hearing at the Crown Court. Civilian witnesses gave evidence for both the prosecution and the defence. The defence attacked the credibility of the prosecution witnesses during cross-examination and highlighted the inconsistencies raised during their evidence. The jury returned a not guilty verdict to both charges.
